As part of our seller onboarding and compliance processes, the Platform makes commercially reasonable efforts to obtain representations, warranties, certifications, licenses, registrations, regulatory approvals, and other assurances from sellers regarding the quality, authenticity, safety, legality, performance, regulatory compliance, and fitness for sale of their products. The Platform may also conduct periodic reviews, verifications, audits, or compliance assessments where appropriate.
However, these reviews, verifications, certifications, audits, approvals, or compliance procedures do not constitute an independent guarantee, certification, endorsement, warranty, or representation by the Platform regarding any product, seller, manufacturer, ingredient, claim, performance characteristic, safety profile, efficacy, regulatory status, or suitability for any particular purpose.
The Platform does not independently manufacture, formulate, test, inspect, validate, certify, analyze, or continuously monitor products offered by third-party sellers. Therefore, the Platform cannot guarantee the accuracy, completeness, reliability, safety, effectiveness, quality, legality, merchantability, authenticity, fitness for purpose, or regulatory compliance of any product made available through the Platform.
All responsibility for product design, formulation, sourcing, manufacture, importation, storage, transportation, labeling, packaging, instructions for use, marketing claims, warnings, regulatory compliance, quality control, safety monitoring, product recalls, and post-market obligations rests exclusively with the applicable seller, manufacturer, importer, or other responsible party within the supply chain.
To the fullest extent permitted by applicable law, the Platform expressly disclaims all representations, warranties, conditions, guarantees, and liabilities relating to products sold by third-party sellers, including but not limited to:
Customers acknowledge and agree that every purchase made through the Platform is made directly from the applicable third-party seller. Any claim, complaint, loss, injury, damage, adverse reaction, product defect, recall, regulatory issue, or other liability arising from or relating to a product shall be the sole responsibility of the seller, manufacturer, importer, or other responsible party.
Nothing contained on the Platform shall be construed as medical, pharmaceutical, nutritional, legal, financial, or professional advice. Customers are encouraged to seek advice from qualified professionals before purchasing or using any product where appropriate.
The Platform reserves the absolute right, but assumes no obligation, to investigate, suspend, restrict, remove, delist, report, or otherwise take action against any seller, product, listing, or transaction where such action is reasonably necessary to:
